Résumé: مـلخص: يعتبر موضوع إثبات الملكية العقارية الخاصة، من أهم المواضيع التي تطرح نفسها في ميدان القانون الخاص وهذا نظرا للصعوبات العلمية والعملية التي تكتنف هذا الميدان خصوصا بين فئة الباحثين والمطبقين، ويظهر هذا جليا من خلال القرارات القضائية المتناقضة، الصادرة بهذا الخصوص ولعل ذلك راجع إلى الإجراءات التقنية المعقدة التي يعالجها موضوع الإثبات، لاسيما في الأراضي التي لم تشملها بعد عملية المسح العقاري لاسيما وأن الدولة في المناطق الغير ممسوحة لا تملك رؤية واضحة فيما يخص الملكيات العقارية الموجودة على أرض الواقع، الأمر الذي أدى في آخر المطاف إلى خلق عدة حلول ظرفية تمليها في بعض الأحيان المصلحة الخاصة للأفراد، وفي أحيان أخرى المصلحة العامة للبلاد. This is due to the scientific and practical difficulties that surround this field, especially among the researcher and the applied class. This is evident in the contradictory judicial decisions issued in this regard. The complex technical procedures dealt with by the subject of proof, especially in lands that have not yet been covered by the survey process, especially that the state in the areas not surveyed do not have a clear vision regarding real estate properties on the ground, which eventually led to the creation of several Circumstantial solutions sometimes dictated by the private interests of individuals and at other times the public interest of the country. .
