وثيقة الشّحن الإلكترونيّة

Résumé: إنّ موضوع سند الشّحن الالكتروني من مواضيع السّاعة، أصبحت تفرضه متطلبات عقود التّجارة البحريّة الإلكترونيّة لاسيّما عقود النقل البحري للبضائع الّتي تستدعي طبيعته ضرورة اثباته بسندات تتّسم بطابع الكتروني، تبرز أهمّ إيجابياته في كسب الوقت وضمان السرعة في تنفيذ المعاملات التجارية البحرية، ويساهم في التقليل من العراقيل التي تصادف المتعاملين به في مجال النقل البحري، بما أنّه يطرح هو الآخر اشكالات قانونية نتوقف على بعضها من خلال هذه الورقة البحثية. The subject of the electronic bill of lading is topical. It has become imposed by the requirements of contracts for electronic maritime commerce, particularly contracts for the carriage of goods by sea. the nature of which implies the need to prove it on bonds of an electronic nature, appear its advantages in gaining time and ensuring speed in the execution of maritime commercial transactions, It contributes to reducing the obstacles faced by shipping operators, Since it also poses legal issues that we stop at each other through this paper.
