طرق الطعن في الأمر الجزائي و إشكالات تنفيذه في التشريع الجزائري

Résumé: ملخص على خلاف الأحكام الجنائية لم يجز القانون الطعن في القرارات الصادرة وفقا لنظام الأمر الجزائي باعتبار أن إجراءات الطعن تستغرق وقتا طويلا من شأنه إهدار الغاية المنشودة من وراء تطبيق هذا النظام. إلا أن مقتضيات العدالة تستلزم وجوب إعطاء المتهم بديل آخر يضمن له حقوقه بصورة تتسق مع هذا النظام ويتمثل هذا البديل في حق الاعتراض على الأمر الجزائي في حالة ما إذا لم يحصل الاعتراض على الأمر الجزائي فإنه يصبح بمثابة حكم نهائي تنقضي به الدعوى الجنائية، فلا يجوز إقامتها على ذات الفعل، ويكون واجب التنفيذ، غير أنه أثناء تنفيذ الأوامر الجزائية قد تطرأ بعض الإشكالات في تنفيذه مما يبرر ضرورة إعطاء المتهم حق الإستشكال على الأمر الصادر في حقه خصوصا وأن هذا النظام لا يعرف طرق الطعن التي يعرفها الحكم الجزائي. SUMMARY Unlike criminal rulings, the law does not permit appeals against decisions issued in accordance with the penal order system, considering that appeal procedures take a long time, which would defeat the desired goal behind implementing this system. However, the requirements of justice require that the accused must be given another alternative that guarantees his rights in a manner consistent with this system. This alternative is the right to object to the criminal order. In the event that the objection to the criminal order is not obtained, it becomes a final ruling that ends the criminal case, so it may not be brought on The same act, and it is obligatory to implement it. However, during the implementation of criminal orders, some problems may arise in its implementation, which justifies the necessity of giving the accused the right to challenge the order issued against him, especially since this system
