الجريمة البيئية في ظل أحكام القانون الدولي الجنائي Environmental Crime Under The International Criminal Law Provisions

Résumé: إن الانتهاكات الدولية للبيئة وتلويثها تعتبر جريمة دولية يترتب عنها قيام المسؤولية الجنائية الدولية لمرتكبيها، بحكم أنها تمس بحق يحميه القانون الدولي الجنائي، وعليه أصبح من الضروري حماية البيئة من كل صور الاعتداءات التي تقع عليها، زمن النزاعات المسلّحة الدولية وغير الدولية. تتناول هذه الدراسة التعريف بالمبادئ القانونية، والنصوص الاتفاقية المتعلقة بحماية البيئة الطبيعية من آثار العمليات العدائية أثناء النزاعات المسلحة، وما تضمنه النظام الأساسي للمحكمة الجنائية الدولية من جرائم بيئية، وذلك للإجابة عن الإشكالية المطروحة حول مدى كفاية هذه القواعد لمنع الانتهاكات الجسيمة الواقعة على البيئة. The international violations of the environment and its pollution are considered as an international crime that entails the international criminal responsibility of its perpetrators, as it affects a right protected by international criminal law. Therefore, it has become worthy to protect the environment from all forms of attacks that may occur during international armed conflicts and non- international. In this study, we discuss the definition of the various legal principles, convention texts related to the protection of the natural environment from the effects of hostilities during armed conflicts, and what the Rome statute contains of environment crimes, in order to answer the raised problematic about the adequacy of these rules to prevent serious violations of environmental.
