الإطار القانوني للإستثمار في الجزائر- دراسة مقارنة بين القانون الجزائري و الفرنسي-

Résumé: الملخص:عرفت الجزائر منذ الإستقلال عدّة قوانين خاصة بالإستثمار قصد تشجيع الإستثمار المحلي وجلب الإستثمار الأجنبي وقامت بمجموعة من الإصلاحات في سبيل دعم وإستقطاب المستثمرين الأجانب، لكن لم ترقى كل هذه الإصلاحات إلى تحقيق الهدف المنشود، ولازالت ليومنا هذا تبحث في إصدار قانون إستثمار جديد، خلافاً على قوانين الإستثمار الفرنسية التي لعبت دوراً كبيراً في الإنفتاح على الأسواق الدولية وجلب المستثمرين الأجانب وحتى في خلق إستثمارات فرنسية على المستوى الدولي. وبهدف الوصول إلى مقارنة القانونيين الجزائري والفرنسي ومدى تأثيرهما على دفع عجلة التنمية وتطوير الإستثمار لجأنا عن طريق منهجية تحليلية إلى تحليل نصوص القوانين الصادرة ومدى تأثيرها على نمو الإستثمار. Abstract: Algeria has known since independence several investment laws in order to encourage local investment and attract foreign investment. Algeria carried out, as well, a set of reforms in order to support and attract investors, but not all of these reforms amounted to achieve the expected goal. To this day, Algeria is still looking into issuing a new investment law, in contrast to the French investment laws which played a major role in opening up to international markets, attracting foreign investors, and even creating French investments at the international level. In order to reach a comparison of the Algerian laws and French laws and the extent of their impact on advancing the wheel of development and investment development, I resorted, through an analytical methodology, to the analysis of the texts of the issued laws and their impact on investment growth.
