الضوابط الشرعية لإصدار وتداول الصكوك المالية الإسلامية بين التنظير والتطبيق

Résumé: تهدف هذه الدراسة إلى توضيح مختلف الضوابط الشرعية الحاكمة لإصدار وتداول الصكوك المالية الإسلامية، ومدى تطبيق هذه الضوابط في الواقع العملي، وقد خلصت الدراسة إلى أن ضوابط الصكوك تختلف باختلاف أنواع الصكوك، المرحلة التي يمر بها المشروع، طبيعة نشاط الشركة، غير أنه وفي الواقع العملي توجد العديد من التجاوزات لهذه الضوابط مما قد يبطل شرعية هذه الصكوك. This study aims at clarifying the various Shari'ah controls governing the issuance and Trading of Sukuks and the extent to which these controls are applied in practice. The study concluded that the sukuk controls differ according to the types of sukuk, the stage of the project, the nature of the company's activity, but in practice these rules are not strictly observed.
