أثر التعديل الدستوري في الجزائر بموجب القانون رقم 16/01 على الحقوق والحريات العامة The Effect Of The Constitutional Amendment In Algeria Under Law No. 16/01 On Public Rights And Freedoms

Résumé: ملخص/ تعتبر الحقوق والحريات العامة في الجزائر من المبادئ والأسس التي ارتكزت عليها كل الدساتير المتعاقبة وذلك لارتباط ممارستها بالمواطنين والأفراد الذين يمثلون المكون الأساسي في الدولة والذي تدور حوله مختلف المكونات الأخرى وتعمل من أجله. فالتعديل الدستوري الأخير في الجزائر بموجب القانون رقم 16/01 المؤرخ في 06 مارس 2016 عرف نوع من التكريس والرُقي بالحقوق والحريات العامة الذي شمل تدعيم لحقوق وحريات المرأة في مجال التشغيل وتشجيع ترقيتها في مناصب المسؤولية في الهيئات والادارات العمومية، فضلًا على تدعيم مجال حماية حرمة الانسان من خلال قمع القانون للمعاملات اللاإنسانية والمهينة التي قد يتعرض لها، بالإضافة إلى تكريس حرية المعتقد من خلال ضمان حرية ممارسة العبادة في ظل احترام القانون، وفتح المجال أمام حرية الاستثمار في المجال الاقتصادي، وضمان ممارسة الحريات الأكاديمية وحرية البحث العلمي في اطار القانون، مع ارتقاء بحريات الاجتماع وتدعيم للحرية الاعلامية والحزبية، زيادةً على العمل على تفعيل دور الشباب في المجتمع وضمان حق الثقافة للمواطنين وحماية التراث الثقافي، لكنّ هذا التنصيص الدستوري في الواقع يحتاج إلى إطار قانوني يجسدهُ حتى تتحقق الإضافة المرجوة منه. Abstract/ The general rights and freedoms in Algeria are among the principles enshrined in all successive constitutions، because the relationship of its practice with citizens and individuals who represent the main component of the State, in which various other components are active and working. The recent constitutional amendment in Algeria issued by Law No. 16/01 of 06 March 2016، in which the constitutional founder affirmed the necessity of promotion of public rights and freedoms، including the promotion of women's rights and freedoms in employment and promotion of their positions of responsibility in public, bodies and departments، To strengthen the protection of human inviolability through the suppression of the law of inhuman and degrading treatment, as well as to enshrine freedom of belief by guaranteeing freedom of worship, and freedom in the economic field، and to ensure the exercise of academic freedoms and freedom of scientific research within the framework of the law, and improve the freedoms of the meeting and political parties with the strengthening of media freedom, and in addition to activate the role of youth in society and guarantee the right of culture for citizens and the protection of cultural heritage. These principals، In fact need a legal framework to be realized and to achieve their desired goals.
