Résumé: ملخص: لقد تبنى المؤسس الدستوري ضمن التعديل الدستوري لسنة 2020 آلية الدفع بعدم دستورية القوانين وتم تعزيز ذلك عن طريق المحكمة الدستورية بموجب التعديل الدستوري لسنة 2020 وذلك من أجل تعزيز الحقوق والحريات وإرساء دعائم دولة القانون من خلال هذه الآلية وعليه سيتم البحث في المنظومة القانونية والإجرائية لسير المحكمة الدستورية كآلية لممارسة الدفع بعدم دستورية القوانين الماسة بالحقوق والحريات وذك من أجل معرفة مساهمتها في إرساء الحقوق والحريات وتكريس دولة القانون كلمات مفتاحية: المحكمة الدستورية ، الدفع بعدم الدستورية ، دولة القانون الحقوق والحريات . Abstract : The constitutional founder, within the constitutional amendment of 2020, adopted the mechanism for pushing the unconstitutionality of laws, and this was reinforced by the Constitutional Court under the constitutional amendment of 2020 in order to strengthen rights and freedoms and establish the foundations of the rule of law through this mechanism. Accordingly, the legal and procedural system for the functioning of the Constitutional Court will be discussed.
