Résumé: يشكل القضاء الدستوري آلية لحماية الحقوق والحريات المنصوص عليها دستوريا من تعسف المشرع اثناء تنظيمها، ويظهر ذلك جليا في قضاء المجلس الدستوري الفرنسي الذي كان له دور إنشائي في هذا المجال، وهو ما تبينه قراراته في مجال المحاكمة المرئية ما يبين فلسفته في الموازنة بين الحقوق والحريات وحفظ النظام العام والمال العام. الكلمات المفتاحية : المحاكمة المرئية، المجلس الدستوري، اللجوء، الحبس الاحتياطي.
