Résumé: يحاول البحث أن يبيّن إلى أي مدى يمكن للمستجدات أن تؤثر في المعاملات المالية تحليلاً وتحريماً، صحة وفسادًا، من خلال بعض التطبيقات الواردة في المعايير الشرعية الصادرة عن هيئة المحاسبة والمراجعة للمؤسسات المالية الإسلامية (الأيوفي( ، وكيف يمكن ضبط هذا التأثير حتى لا ينحرف عن مساره. وقد حاولت أن أُبيّن أهمية الفقه بالواقع لصحة الاجتهاد، وإبراز دور الفقه الإسلامي في معالجة المستجدات في المجال المالي، وأنه قادر على التفاعل الإيجابي مع الواقع المعاصر، وما خلصت إليه من هذا البحث: أن العناية بالمستجدات واعتبارها في الاجتهاد الفقهي لا يعني الخضوع لضغوط الواقع المعاصر، وأن تجديد الاجتهاد مطلب شرعي وضرورة يقتضيها الواقع المتغير، حتى يكون الفقه قادرًا على تقديم الحلول للمشكلات المعاصرة. Abstract: The research tries to show the extent to which developments can affect financial transactions, validity and corruption, Through some applications contained in the Sharia standards issued by the Accounting and Auditing Organization for Islamic Financial Institutions (AAOIFI), And how can this influence be controlled so as not to deviate from its path. and I have tried to show the importance of jurisprudence in reality for the validity of ijtihad, and to highlight the role of Islamic jurisprudence in dealing with developments in the financial field, and that it is capable of positive interaction with contemporary reality, And what I concluded from this research: that taking care of developments and considering them in ijtihad does not mean submitting to the pressures of contemporary reality, and that renewing ijtihad is a legal requirement and a necessity required by the changing reality, so that jurisprudence is able to provide solutions to contemporary problems.
