النظام الإجرائي لتأديب الموظف العام

Résumé: يعد خروج الموظف العام عن مقتضى الواجب الوظيفي خطأ يستوجب العقاب، ونظرا لخطورة الجزاء في بعض الحالات والآثار المترتبة عن ذلك فقد أحاط المشرع الجزائري عملية متابعة الموظف تأديبيا بقواعد إجرائية واضحة حددتها أحكام الأمر رقم 06/03 المتضمن القانون الأساسي العام للوظيفة العمومية، تشكل في ذات الوقت ضمانات للموظف العام تمكنه من ممارسة حقوقه في هذا الشأن لاسيما حق الطعن أمام الجهات القضائية في حال الخروج عن مقتضى المشروعية في توقيع الجزاءات. ا Summary: The departure of the public employee from the necessity of Job Duty is an error that requires punishment, and Given the seriousness of the penalty in some cases and the implications, The Algerian legislator has surrounded the employee's disciplinary follow-up process with clear procedural rules that outlined by Provisions of Ordinance No. 06/03 which includes the General Basic Law of public employment.
