حماية المستهلك الإلكتروني في ظل قانون التجارة الالكترونية الجزائري

Résumé: من الاهتمامات الجدّية التي تقع على عاتق الدولة الجزائرية حماية المستهلك الالكتروني، ذلك نظرا للتطور التكنولوجي وتطور وسائل الاتصال في عصر الحديث، بالمقابل تم إصدار قانون التجارة الإلكترونية و تعديل كل من قانون حماية المستهلك والقانون المتعلق بشروط ممارسة الأنشطة التجارية، وذلك لتدعيم النظام الحمائي العام في هذا المجال. إنّ وضع منظومة تشريعية تؤطر التجارة الإلكترونية يندرج في إطار الإجراءات التي تهدف إلى إرساء جو الثقة في مجال المبادلات الإلكترونية و ترقية الخدمات الإلكترونية لفائدة المواطن بهدف تسهيل ولوجه إلى السلع و الخدمات عن بعد عبر الاتصال الإلكتروني. من خلال ما سبق ذكره سنتناول موضوع مداخلتنا الأحكام القانونية السارية على حماية المستهلك الإلكتروني في ظل القوانين سالفة الذكر. Abstract: One of the major concerns of the Algerian State is the protection of electronic consumers, due to the technological development and means of communication in the modern era where the authorities have promulgated the law on electronic commerce and modifying the both the laws on consumer protection and the law relating to the exercise of commercial activities, to strengthen the system of General Protection in this area. The development of a legislative system which regulates electronic commerce is part of the procedures aimed at establishing a climate of confidence which will lead to the generalization and development of electronic exchanges and the construction of an information society. Which aims to modernize electronic services for the benefit of citizens in order to facilitate access to goods and services at a distance via Mail communication? From this point of view, we will approach the subject of our intervention, the legal provisions applicable to the electronic protection of consumers under the aforementioned laws.
