البيو-أخلاقيات الطبية في مجال نزع و زرع الأعضاء و الأنسجة و الخلايا البشرية و تنظيمها القانوني في التشريع الجزائري

Résumé: سمحت البيو-أخلاقيات الطبية بخلق توازن بين حرمة جسم الانسان و بعث آمال جديدة لشفائه في ظل تطور الأبحاث في البيولوجيا الحيوية و الطب، و من جانبها مهدت الإجتهادات الفقهية الطريق أمام عمليات التبرع بالأعضاء و الأنسجة و الخلايا البشرية بين الأحياء و من الموتى إلى الأحياء. هذا ما دفع المشرع الجزائري إلى تكييف المنظومة القانونية في هذا المجال. لكن واقع التجربة الجزائرية في نزع وزرع الأعضاء يعرف توسعاً في قائمة الانتظار للمرضى في حين لم تعرف عملية نقل الأعضاء من الموتى انطلاقة حقيقية، و هو ما يدعوا لإيجاد آليات أكثر فعّالية خصوصاً فيما يخص استعمال أعضاء الموتى في عمليات الزرع. الكلمات المفتاحية: البيو-أخلاقيات ، نزع و زرع الأعضاء، المتبرع الحي، المتبرع الميت :Abstra bioethics allows an equilibrium between the sanctity of human body and rise new hopes for its recovery in light of the development in research in biology and medicine. For its part, jurisprudence has paved the way to organ donation, and tissue, and human cells either between alive persons or from dead person to alive. This is what prompted the Algerian legislator to adapt the legal system in this field . But the Algerian experience in organ transplantations still knows a great delay, as the waiting list is expanding, while the process of transferring organs from the dead has not known a real start .by this way it s urgent to seeking to find more effective mechanisms regarding the use of the organs of the dead in transplantation .
