توسيع صلاحيات الوالي في مجال المحافظة على الصحة العامة في ظل تفشي فيروس كورونا (كوفيد 19)

Résumé: تهدف هذه الدراسة إلى إبراز دور الوالي في المحافظة على الصحة العامة للمواطنين في ظل تفشي وباء كورونا(كوفيد19)، الذي أصبح يشكل خطرا على الصحة العامة، وباعتباره ظرفا استثنائيا وغير متوقع فرض على سلطات الدولة ضرورة اتخاذ إجراءات وقائية استثنائية لمكافحته والحد ن مخاطر الإصابة بهذا الفيروس حماية الصحة العامة، ولما كان الوالي ممثلا للإدارة المركزية على المستوى المحلي فقد خول له المشرع صلاحيات واسعة وسلطة تقديرية أوسع لاتخاذ كل اجراء يراه مناسبا للحد من انتشار فيروس كورونا حفاظا على الصحة العامة التي تعد هدفا من أهداف الضبط الاداري، وقد اعتمدنا في هذه الدراسة على المنهج الوصفي من خلال تعريف الصحة العامة وتحديد طبيعة الظرف الذي تعرفه البلاد في ظل تفشي وباء كورونا، بالاضافة الى استقراء النصوص القانونية المنظمة لسلطات الوالي الضبطية في حماية الصحة العامة في ظل تفشي هذا الوباء. ومن أهم النتائج المتوصل إليها أن توسيع صلاحيات الوالي الضبطية في ظل تفشي فيروس كورونا في تقييد الحقوق والحريات ليس الغرض منه مجرد حرمان الأفراد من التمتع بحقوقهم وحرياتهم وإنما الهدف الأساسي منه هو مكافحة الوباء والحد من انتشاره حماية للصحة العامة، غير أن الوالي ملزم في هذا الإطار باحترام الحدود المرسومه له قانونا. Abstract: This study aims to highlight the role of the governor in preserving the public health from of the spread of Corona epidemic (Covid 19),that poses a serious threat to the public health, and as this epidemic is an exceptional and unexpected circumstance it obligates the administrative authorities to take exceptional preventive measures to protect public health from the risk of infection. As the governor is the representative of the central administration, the legislator has granted him wide powers and discretionary authority to take any measures to limit the spread of the Corona-virus and preserve the public health which is one of the the purposes of administrative police. In this study we adopted the descriptive approach in definition public health and determining the nature of the circumstance that the country knows and induction the legal text regulating governor’s powers in preserving public health. The most important results in this study is the objective of expanding the governor’s powers in restricting individuals rights and freedoms is not depriving individuals of their rights and freedoms. Rather, the main objective of it is to combat the epidemic and reduce its spread in order to protect public health. However, the governor is obligated when practicing this Powers to respect the legal texts regulating his powers.
