بدائل الدعوى الجنائية - دراسة خاصة في العوامل المساهمة في ظهورها –

Résumé: الملخص: تعاني العدالة الجنائية أزمة حادة تكاد تصيبها بالشلل، وبات تحديث آلياتها في اقتضاء حق الدولة في العقاب ضرورة ملحة، وذلك من خلال استبعاد العقوبة الجنائية وعدم التركيز عليها كوسيلة وحيدة لمعالجة الجريمة ومن ثم هجر فكرة الدعوى الجنائية في الجرائم قليلة الخطورة كثيرة العدد التي أصبحت سمة للدولة المعاصرة. كما أصبح البحث عن أسلوب آخر مرن لحل الخصومات الجنائية مسألة تفرض نفسها في خضم منطق بحث المجتمعات على عدالة ناجزة عالية الجودة في مكافحة الظاهرة الإجرامية. وكانت خلاصة هذا التفكير أن قامت جل التشريعات الإجرائية المقارنة ما نسميها ببدائل الدعوى الجنائية كأساليب غير قضائية لإدارة العدالة الجنائية، وهي تمثل ثورة أسهمت في الوصول إليها العديد من العوامل والأسباب، وهو ما نسلط عليه الضوء في هذا المقال، الذي يدور حوله أهم العوامل المساهمة في إيجاد بدائل للدعوى الجنائية كآليات للتخفيف من وطأة الأزمة. الكلمات المفتاحية: العدالة الجنائية، بدائل الدعوى الجنائية، السياسة الجنائية، الضحية، المتهم. Abstract : Criminal justice suffers an acute crisis which led to a quasi paralysis, and the modernization of its mechanisms in the state's right to punishment has become an urgent necessity, by excluding the criminal penalty and not taking it as the only way to deal with crime, then quiting the idea of criminal case in the kind of crimes that are numerous and less dangerous which became a feature of the contemporary state. The search for another flexible method for resolving criminal conflicts has become an issue imposes itself in the medium of the societies seeking logic for a high-quality justice in combating the criminal phenomenon. The summary of this thinking was that most of the comparative procedural legislations have taken what we call Criminal Case Alternatives as non-judicial methods for managing criminal justice, which considers as a revolution and there are many factors and causes that contributed to reach, and that what we highlight in this article which revolves around the most important contributing factors for finding Criminal Case Alternatives as mechanisms to alleviate the impact of the crisis.
