التحفظات التفسيرية وتطبيقاتها في الاجتهاد الدستوري الجزائري

Résumé: تتستهدف هذه المقالة تسليط الضوء على أهمية الدور الذي يلعبه القضاء الدستوري في عملية تفسير النصوص القانونية من خلال تقنية التحفظات الدستورية، ومدى إلزامية وحجية هذه التحفظات، وأخيرا تطبيقات هذه التقنية في الاجتهاد الدستوري في الجزائر انطلاقا من تجربة المجلس الدستوري الجزائري ثم المحكمة الدستورية في مجال الرقابة الدستورية ورقابة المطابقة من خلال تقنيتي الاخطار والدفع بعدم الدستورية. TThis article aims to highlight the importance of the role played by the constitutional judiciary in the process of interpreting legal texts through the technique of interpretative reservations, the extent of the mandatory and authoritativeness of these reservations, and finally the applications of this technique in Algeria's constitutional jurisprudence, based on the experience of the Algerian Constitutional Council Then the Constitutional Court in the field of constitutional control and conformity control through the techniques of referral and exception of unconstitutionality
