تأثر إثبات عقد الوقف بنظام الإثبات في القانون المدني والقانون التجاري الجزائري

Résumé: يُعتبر الوقف شكلا من أشكال الصدقة الجارية، وميدانا خصبا للتنافس على فعل الخير وتحصيل البرّ، وبالنظر إلى أهميته الاجتماعية والاقتصادية، فإن الجزائر قد أولته اهتمامها وجعلته من أولويات سياستها التشريعية من خلال حزمة القوانين التي أصدرتها، وتعزيزا لهذه الأهمية فقد كرّس التشريع حماية الأملاك الوقفية من صور الإعتداء والتملّك غير المشروع، من خلال تمكين أصحابها من إمكانية إثباتها بطرق الإثبات المتاحة شرعا. في هذا السياق، يستهدف هذا المقال بحث إشكالية إثبات عقد الوقف، لكن من خلال التركيز على جوانب وملامح تأثره بطرق الإثبات التي قرّرها المشرع الجزائري في كل من القانون المدني والقانون التجاري. The Waqf is a form of ongoing charity, a fertile ground for competition for good and for righteousness, and in view of its social and economic importance, Algeria has given it its attention and made it a priority in its legislative policy through the package of laws that it has promulgated, and in furtherance of this importance it has The legislation enshrines the protection of Waqf property against unlawful misappropriation, by enabling its owners to be able to prove it through the legally available means of proof. In this context, this article aims to discuss the issue of proving the endowment contract, but by focusing on aspects and features influenced by the methods of proof established by the Algerian legislature in both civil and commercial law.
