التكوين القانوني للعقد السياحي وفق التشريع الجزائري

Résumé: إن اتساع الأنشطة السياحية التي تقوم بها وكالات السياحة والسفر يثير عدة إشكالات ولعل أهمها هو تحديد الوصف القانوني للعقد السياحي ونطاق التزامات أطرافه، وهو ما جعل المشرع الجزائري يتدخل بنصوص تنظيمية بما يتلاءم مع خصوصية هذا العقد من خلال القانون رقم 99_06 الذي يحدد القواعد التي تحكم نشاط وكالة السياحة و السفر. ومن هنا جاءت أهمية هذه الدراسة الموجزة للعقد السياحي لنوضح الإطار القانوني لهذا العقد وتوضيح طبيعته القانونية لما لها من أثر في تحديد مسؤولية كل من السائح من جهة ووكالة السياحة والسفر من جهة أخرى. The breadth of tourism activities carried out by tourism and travel agencies raises several problems, perhaps the most important of which is defining the legal description of the tourism contract and the scope of the obligations of its parties, which made the Algerian legislator intervene with regulatory texts in line with the privacy of this contract through Law No. 99_06 that defines the rules governing the activity Tourism and travel agency. Hence the importance of this brief study of the tourism contract came to clarify the legal framework for this contract and clarify its legal nature because of its impact in determining the responsibility of both tourists on the one hand and the travel and tourism agency on the other
