مفهوم وآليات الضبط الاداري البيئي في الجزائر

Résumé: الملخص: من اجل حماية البيئة سخر المشرع الجزائري للإدارة وسائل قانونية للقيام بهذه المهمة للحد من ظاهرة التعسف على البيئة والوصول إلى محيط و بيئة نظيفة خالية من جميع أشكال التلوث، هذه الوسائل تختلف حسب طبيعة المهمة المراد تحقيقها فقد تتدخل بصفة انفرادية حسب سلطات وصلاحيات الضبط الإداري البيئي ، هذا الاخير يعد من افضل الوسائل التي بحوزة الادارة لتجسيد حماية البيئة ، لاسيما أن مهام الضبط الإداري ذات طابع وقائي باعتبارها تهدف إلى المحافظة على النظام العام، باتخاذ ما يلزم من تدابير و إجراءات لتفادي المساس به في مختلف عناصره ، وهذا ما يتطابق و ينسجم مع أهم مبادئ استراتيجية حماية البيئة التي تقوم على مبدأ الوقاية . اعترفت النصوص القانونية في الجزائر للهيئات الادارية خاصة " الولاية، البلدية" بصلاحيات ضبطية في مجال حماية البيئة و تتوزع تلك الصلاحيات و تتناثر بين النصوص العامة كما هو الحال بالنسبة لقانوني البلدية و الولاية و قانون حماية البيئة نفسه من جهة ، و النصوص الخاصة بحماية مجالات معينة لها علاقة مباشرة بالبيئة من جهة أخرى . Abstract : To protect the environment, the Algerian legislator gave the administration legal means to do this job, and prevent the phenomenon of harming environment and reach a clean and pure surrounding environment of all kinds of pollution. These means differ according to the nature of the mission needed to be accomplish, it may interfere in individual way according to the authorities and the power of the environmental management control, which is one of the best means that the administration has to apply the protection of environment, in the end the tasks of administrative control are made for protection, it is considered to maintain the public order by taking the necessary acts and procedures to avoid harming it or harming its elements, all these are coping with the most important strategy principles which are based upon protection. The legal laws in Algeria approved to the administrative organizations especially “ Wilaya and Baladia” the legal authorities in the field of environment , these authorities is divided between public laws like the law of Wilaya and Baladia and the law of environment protection itself, in addition to laws devoted to protect certain fields that have direct relation with environment.
