فعالية عقد حفظ الحق في حماية التوقع المشروع

Résumé: في ظل التطورات المتسارعة في مجال المعاملات القانونية والاقتصادية، برز عقد حفظ الحق كآلية قانونية هامة لحماية الحقوق والتوقعات المشروعة للأطراف المتعاقدة، يستند هذا العقد إلى مبدأ حماية الأطراف من التعديلات غير المتوقعة التي قد تهدد مصالحهم الأساسية، ويوفر إطارا قانونيا مرنا للتكيف مع الظروف المتغيرة، تكمن إشكالية البحث في تقييم فعالية عقد حفظ الحق في توفير الحماية اللازمة للتوقعات المشروعة، خاصة في مواجهة المخاطر غير المتوقعة، يهدف البحث إلى تحليل شامل لفعالية هذا العقد من خلال دراسة الأطر القانونية والتشريعية، وتقييم دوره في تعزيز استقرار العلاقات التعاقدية، مع تقديم رؤية متكاملة واقتراحات لتعزيز دوره في تحقيق الإستقرار القانوني. With the fast development of legal and economic transactions, the Right Preservation Contract has emerged as an important legal mechanism with respect to the protection of the rights and legitimate expectations of the parties to the contract. In its very essence, the Right Preservation Contract is based upon the protection of the parties against variations that might come as a surprise and threaten their basic interests by providing a flexible legal framework which could deal with the changeable circumstances. The problem under examination is how to assess the sufficiency and adequacy of the Right Preservation Contract in providing the given scope of protection for legitimate expectations in case of unexpected risks. The research will work on presenting a holistic analysis of the effectiveness of this contract by studying the legal and legislative frameworks, assessing the role that this contract has played in enhancing contractual relationship stability, and providing an integrated point of view with suggestions for enhancing its role in achieving legal stability.
