السياسة الجنائية في مواجهة الاعتداءات الماسة بالمقدسات الإسلامية في التشريع الجزائري

Résumé: حفاظا من المشرع الجزائري على الوحدة الدينية للمجتمع المسلم باعتبارها من أولويات الأمن القومي الجزائري، وفي إطار مواجهته لمختلف أشكال التعدي على المقدسات الإسلامية ، جرم العديد من الأفعال التي تشكل اعتداء على المقدسات الإسلامية من خلال نصوص قانون العقوبات أو بعض النصوص الخاصة. وفي هذا الصدد يطرح التساؤل حول فعالية نصوص قانون العقوبات الجزائري في مواجهة أشكال التعدي على المقدسات الإسلامية؟. على الرغم من اهتمامه بهذه المقدسات وحمايتها إلا أنه لم يحقق الردع الكافي في مواجهة هذه الظاهرة الإجرامية ولم ينجح في الحد منها، وذلك لأنه لم يجرم بعض الأفعال كإنكار النبوة، سب الذات الالهية، تعطيل الشعائر، كما تتميز العقوبات التي أقرها المشرع الجزائري بأنها عقوبات مخففة مقارنة بالأحكام الشرعية لها. In order to preserve the religious unity of the Muslim community as one of the priorities of the Algerian national security, and in the context of its confrontation with various forms of encroachment on Islamic sanctities, the Algerian legislator has criminalized many acts that constitute an attack on Islamic sanctities through the provisions of the penal code or some special texts. In this regard, the question arises about the effectiveness of the provisions of the Algerian penal code in confronting all forms of encroachment on Islamic sanctities? Despite his interest in these sanctities and their protection, he did not achieve sufficient deterrence in the face of this criminal phenomenon and did not succeed in reducing it, because he did not criminalize some acts, and the penalties approved by the Algerian legislator are characterized as light penalties Compared to the legal rulings that have been decided upon
