مدى اعتبار فيروس كورونا-كوفيد 19- أحد أسباب إعفاء الناقل البحري للبضائع من المسؤولية

Résumé: لقد أدى ظهور فيروس كورونا – كوفيد 19- وانتشاره على نطاق واسع إلى حالة من الهلع وسط المجتمع الدولي، مما أدى بالدول إلى إعلان حالة الطوارئ وتطبيق قيود الحجر الصحي حفاظا على صحة العامة، واعتبار فيروس كورونا حالة من حالات القوة القاهرة . هذه الإجراءات المتخذة كان لها من الآثار على المستوى الاقتصادي و القانوني ، سيما على حركة النقل البحري للبضائع ، مما أثار التساؤل حول مدى امكانية اعتبار فيروس كورونا- كوفيد19- كأحد أسباب اعفاء الناقل البحري للبضائع من المسؤولية. Abstract: The emergence and widespread spread of the corona virus – covid 19- has led to a state of panic among the international community , leading states to declare a state of emergence and apply quarontine restrictions for the sake of public health , and to consider the corona virus to be a case of force majeure . These measures taken had economic and legal effects, especially on the maritime transport of goods, which raised the question about the possibility of considering the Corona virus - Covid 19 - as one of the reasons for exempting the shipping carrier of goods from responsibility.
