Résumé: ترتب على إعلان منظمة الصحة العالمية أنّ فايروس كورونا COVID19 جائحة عالمية إصدار العديد من الدول لعدة قرارات بهدف الحد من إنتشار هذا الوباء ومجابهته ،من بينها تقييد لحركة التجارة وتعليق أغلب عمليات النقل الدولي ،الأمر الّذي سيكون له إنعكاس قانوني على عقود النقل البحري الدولي للبضائع المبرمة في ظل ظروف سابقة تختلف كليًا عن الظروف الراهنة ما جعل تنفيذ الإلتزامات التعاقدية مستحيلاً ،وكون هذه الإستحالة ذات أبعاد قانونية وإقتصادية مهمة ستجعل شركات النقل البحري تلجأ إلى إثارة نظرية القوة القاهرة كحالة إعفاء قانوني من المسؤولية لصالح الناقل البحري قررها القانون بموجب المادة 803 فقرة ه من التشريع البحري الجزائري وكذا بموجب الإتفاقيات الدولية المنظمة لأحكام النقل الدولي للبضائع بحرًا ؛فما مدى إنطباق نظرية القوة القاهرة في عقد النقل البحري للبضائع على جائحة COVID19 ؟ The World Health Organization's announcement that the coronavirus-19 is a global pandemic has led to several decisions by many countries to limit the spread of the epidemic, including restricting global trade and suspending most of the global transmission ,this would have a legal effect on contracts for international maritime transport of goods concluded under previous circumstances that are completely different from the current circumstances, making the implementation of contractual obligations impossible.this impossibility has important legal and economic dimensions, which would make shipping companies resort to raising the theory of force majeure as a legal exemption from liability for the maritime carrier as prescribed by law under article 803 -E- of the Algerian Maritime Legislatit and pursiant to international conventions governing international transport of goods , how applicable is the theory of force majeure in the contract of carriage of goods by sea to the COVID-19 pandemic ?
