حق الانسحاب كضمانة للموظف بين الاعتراف القضائي والتجاهل التشريعي . بحث مقارن بين القانون الليبي والقانون الفرنسي

Résumé: ملخص الدراسة : يٌعد موضوع الحماية القانونية للموظف والعاملين في القطاع العام من الموضوعات التي تشغل بال الفقه والقضاء وكذا المشرع في مختلف الأنظمة القانونية المعاصرة، وبالنظر إلى التحول السياسي الذى طرأ في ليبيا بعد الربيع العربي، بات من الملح إعادة النظر في منظومة الحماية القانونية في هذا البلد في ضوء التطورات الفقهية والقضائية التي شهدتها فرنسا مؤخراً على هذا المستوى، لذا أرتئينا أن نخصص هذه الدراسة لأحد هذه الضمانات القانونية الهامة والكشف عن أوجه القصور في التشريع الليبي مقارنة بالتشريع الفرنسي. Abstract: The subject of legal protection of public sector employees and workers is one of the issues that concern jurisprudence and the judiciary as well as the legislator in various contemporary legal systems, and given the transformation As a political event in Libya after the Arab Spring, it has become urgent to review the system of legal protection in this area. The country is in the light of developments in case law and the judiciary which France has recently witnessed at this level, so we felt that we should devote this study to one of these important legal guarantees and reveal the shortcomings of Libyan legislation by relation to French legislation.
