مظاهر اهتمام الدرس الأصولي بقاعدة سد الذرائع: دراسة نظرية تطبيقية

Résumé: ملخص مما لا شك فيه أن لقاعدة سد الذرائع دورا كبيرا في بناء الفروع الفقهية في مختلف المذاهب عليها؛ ولذا نسعى في هذا البحث إلى بيان اهتمام الدرس الفقهي، والأصولي، والمقاصدي بها؟ ناهجا في ذلك منهجي الاستقراء، والوصف التحليلي بأن تتبعت أقوال الأصوليين، والفقها، والمقاصديين، وحللتها تحليلا تطبيقيا، مبينا مظاهر ذلك الاهتمام في الواقع المعيش من خلال الفروع الفقهية؟ وذلك ما سنحاول بيانه في المبحثين: المبحث الأول: الاهتمام بسد الذرائع في الأصول والفقه. والمبحث الثاني: سد الذرائع عند المقاصديين مع استحضار نماذج تطبيقية في كل مذهب من المذاهب الفقهية الأربعة على حدة. وفي الأخير توصلنا إلى نتائج كثيرة منها: إن قاعدة سد الذرائع اختلف حولها من حيث التنظير أما التفريع فالكل يبني عليها. ومنها كذلك أن قاعدة سد الذرائع لها دور كبير في الإجابة على كثير من المستجدات المعاصرة التي سيرمي بها الواقع المعيش، منها لقاعدة سد الذرائع ارتباط وتيق بالمقاصد الشرعية التي هي روح الأدلة. الكلمات المفتاحية: سد الذرائع ــ الفقهي ــ المقاصدي ـ مظاهر ـ الاهتمام Abstract There is no doubt that the rule of blocking the excuses has a major role in building the branches of jurisprudence in the various schools of thought. Therefore, we seek in this research to show the interest of the jurisprudential, fundamentalist, and intentionalist lesson in it. To do so, we have used the inductive method and the descriptive analytical one to track and analyze the says of the fundamentalists, jurists and intentionalists so that we could show the manifestations of that interest in reality. And that is what we will try to explain in this paper which is divided into two sections: the first one deals with blocking the excuses in the fundamental principles and jurisprudence, while the second tackles blocking the excuses for the intentionalists, while recalling applied models in each of the four schools of jurisprudence separately. In the end, we reached many results such as the following: • The theories about the rule of blocking the excuses have been different, but for the branches, everyone builds on this rule. • The rule of blocking excuses has a major role in responding to many contemporary developments that reality brings forward. • The rule of blocking excuses is closely related to the legitimate purposes that are the
