أثر الطلاق على حقوق الطفل

Résumé: هدفت هذه الدراسة إلى تبيين الحقوق المالية وغير مالية للطفل بعد فك الرابطة الزوجية، حيث تم التطرق إلى الإطار المفاهيمي لكل من: حق الطفل في النفقة، وكذا حقه في المسكن، وحقه في الحضانة، وفي الأخير حقه في الرضاع. عالجت الدراسة دور التشريع الجزائري كآلية لضمان حقوق الطفل بعد الطلاق، بتطبيقه لمجموعة من القوانين التي تنظم وتحكم هذه الفئة في الأسرة والمجتمع، بالإضافة إلى دور الشريعة الإسلامية التي نرجع إليها في حالة غياب النصوص وذلك حسب المادة 222 من قانون الأسرة الجزائري. استندت الدراسة على مجموعة متنوعة من المراجع والمصادر والقوانين، حيث تم الوقوف على مدى توفيق المشرع الجزائري في سن قوانين تحمي حقوق الطفل بعد انحلال الرابطة الزوجية، ومن أهم النتائج التي تم التوصل إليها نذكر: توفير كامل أساسيات الحياة الكريمة للطفل المحضون لإبعاده عن كافة المخاطر المحيطة به بعد فراق والديه، وذلك بسن قوانين تضمن له كافة حقوقه المختلفة في حياته اليومية. تدخل المشرع الجزائري من خلال تعديله لقانون الأسرة بمقتضى الأمر05/02. مساهمة الشريعة الإسلامية في جعل الطفل المحضون ذو قيمة في المجتمع، وتوفير له حيز كبير من الأهمية. Summary: This study aimed to clarify the financial and non-financial rights of the child after the dissolution of the marital bond, where the conceptual framework was addressed for each of: the child's right to maintenance, as well as his right to housing, his right to custody, and in the end his right to breastfeeding. The study dealt with the role of Algerian legislation as a mechanism to guarantee children's rights after divorce. By applying a set of laws that regulate and govern this category in the family and society, in addition to the role of Islamic law that we refer to in the absence of texts, according to Article 222 of the Algerian Family Code. The study was based on a variety of references, sources and laws, where the extent of the Algerian legislator's success in enacting laws that protect the rights of the child after the dissolution of the marital bond. Among the most important results that were reached we mention: Providing all the basics for a decent life for the fostered child to keep him away from all the dangers surrounding him after the separation of his parents, by enacting laws that guarantee him all his various rights in his daily life. The Algerian legislator intervened by amending the family law according to Order 02/05. The contribution of Islamic law in making the foster child valuable in society, and providing him with a great place of importance.
