الحماية القضائية لمصلحة الطفل أثناء إجراءات الطلاق Judicial Protection For The Interest Of The Child During The Divorce Process

Résumé: ملخص: كرست الشريعة الإسلامية والقوانين والمواثيق الدولية حق الطفل في الحماية وإيلاء الرعاية الكاملة لمصلحته, بسبب قصوره العقلي وضعفه البدني, ووعيا من المشرع الجزائري بما لظاهرة الطلاق من أثر سلبي على مصلحة الطفل, وإدراك منه بالدور المهم الذي يمكن أن يلعبه القضاء في التخفيف من حدة الأضرار التي تنجم عن حالات الطلاق, أخضع المشرع جميع إجراءات الطلاق للرقابة القضائية. و نظرا لقلة الدراسات التي تعنى بالمرحلة التي تسبق انفصال الوالدين وأثرها على مصلحة الطفل, جاءت هذه الورقة البحثية لإلقاء الضوء على دور القضاء في حماية مصلحة الطفل أثناء هذه المرحلة. الكلمات المفتاحية: مصلحة الطفل؛ القاضي؛ الطلاق ؛ الصلح؛ الاتفاق. Abstract: The Islamic law and international laws and covenants have enshrined the child's right to protection and full care in his interest, due to his mental limitations and physical weakness, and awareness of the Algerian legislator of the negative impact of the phenomenon of divorce on the child’s interest, and his awareness of the important role that the judiciary can play in mitigating the severity of damages Resulting from divorce cases, the legislator subjected all divorce procedures to judicial control. In view of the lack of studies concerned with the phase that precedes the separation of parents and their impact on the interest of the child, this research paper came to shed light on the role of the judiciary in protecting the interest of the child during this phase . key words: The interest of the child; the judge; Divorce; Composition; the agreement.
