إلغاء عقد الامتياز على العقار الصناعي

Résumé: نظم المشرع الجزائري الأحكام القانونية الخاصة بمنح العقار الموجه للاستثمار، مكرسا في ذلك آلية عقد الامتياز باعتباره شكلا قانونيا يتماشى ومقتضيات اقتصاد السوق، حيث تحتفظ الدولة ممثلة في مديريات أملاك الدولة على ملكية العقار أيا كان نوعه، فيما يستفيد المستثمر من حق استغلاله لمدة معينة دون تملكه، متمتعا في ذلك بحقوق والتزامات يحددها دفتر الشروط، غير أن أي إخلال بهذه الالتزامات قد يترتب عليه لجوء الهيئة المانحة لحق الامتياز إلى الهيئات القضائية قصد إلغاء عقد الامتياز. وتهدف هذه الدراسة إلى توضيح الأحكام القانونية المتعلقة بإلغاء عقد الامتياز على العقار الصناعي وكذا الأثار القانونية المترتبة عن ذلك. Abstract: The Algerian legislator regulated the legal provisions for granting real estate directed to investment, relying on the mechanism of the concession contract as a legal form in line with the requirements of the market economy where the state, represented in the directorates of state property, retains ownership of the property of any kind, and the investor benefits from the right to exploit the property for a certain period without owning it., enjoying rights and obligations specified in the conditions book. However, any breach of these obligations may result in the authority granting the concession resorting to judicial bodies in order to cancel the concession contract. Where this study aims to clarify the concept of the concession contract, its legal nature and its pillars, then the legal provisions related to its cancellation as well as its effects.
