أثر اتفاق التحكيم على الكفالة المصرفية

Résumé: ملخص: ترتبط الأعمال المصرفية ارتباطا وثيقا بالكثير من عقود التجارة الدولية لهذا قد يفضل أطرافها اللجوء إلى التحكيم لتسوية ما نشأ أو ما قد ينشأ من منازعات بشأن هذه الأعمال. و تعتبر الكفالة المصرفية أكثر الضمانات المصرفية ذيوعا و انتشارا، وهذا النوع من العمليات المصرفية يفترض وجود عقدين، العقد الأول يربط بين الدائن و المدين و يسمى العقد الأصلي، و العقد الثاني يربط بين البنك الكفيل و دائن المدين ولا يكون الأخير طرفا فيه، وهو عقد الكفالة المصرفية. وعليه، فإن إدراج شرط التحكيم في أحدهما يثير العديد من التساؤلات حول امتداد هذا الشرط للعقد الآخر وأطرافه . :Abstract Banking business is closely related to many international trade contracts, so its parties may prefer to resort to arbitration to settle the disputes that might arise out of their consideration that arbitration has simple and short-term proceedings. bank bail is the most common and widespread bank guarantee. this type of banking operations assumes two contracts, The first, termed the original contract, linking the creditor and the debtor, and the second contract linking the sponsoring bank with the debtor’s creditor, to which the latter is not a party to it, it is the bank guarantee contract. Therefore, the inclusion of the arbitration clause in one of them raises many questions about the extension of this clause to the other contract and its parties.
