أهميّة القواعد الفقهيّة في فقه النّوازل

Résumé: تعالج هذه الورقة البحثية قضية مهمة تتعلق بموضوع الدراسات الفقهية المعاصرة، حيث تسلط الضوء على ضرورة الاستفادة من القواعد الفقهية المقررة في عمل المجتهد أو الفقيه؛ وذلك من أجل التعامل مع القضايا المستجدة أو النوازل المعاصرة اليوم، ابتغاء التكييف الفقهي للنازلة أو الترجيح في المسألة التي تتجاذب فيها الآراء المتعددة، فجاء هذا البحث مؤكدا للباحثين في المجال الفقهي على أهمية استعمال القواعد الفقهية، كما أوضح سبل التعامل مع بعض النوازل الخاصة، وذلك في شكل أمثلة ونماذج لبعض القضايا الشائكة في هذا العصر، مع بيان كيفية التعامل معها وطريقة استخدام القواعد الفقهية في تحديد مسالك العلة وتحقيق المناط .
