مستجدات الوضع تحت المراقبة الالكترونية وفقا للقانون رقم 24-06

Résumé: بغرض مواكبة التطورات العلمية في مجال التكنولوجيا الحديثة، التي شهدتها مختلف دول العالم في شتى الميادين، ظهرت فكرة استخدام هذه التكنولوجيا في مجال عصرنة النظام العقابي لهذه الدول، لتجنب الاثار السلبية للعقوبات السالبة للحرية قصيرة المدة من جهة، ولتخفيف الضغط على المؤسسات العقابية من جهة أخرى، عن طريق البحث عن أساليب عقابية أخرى حديثة تكون بديلة لهذه العقوبات، ومن بينها الوضع تحت المراقبة الاكترونية، هذا الأخير الذي استحدثه المشرع الجزائري مؤخرا كتوجه جديد في المنظومة العقابية، من خلال القانون رقم 24 – 06 المؤرخ في: 28 أفريل 2024 المعدل والمتمم للأمر رقم 66-156 المتضمن قانون العقوبات. على أساس ذلك، يكمن الهدف من هذه الدراسة في تسليط الضوء على مختلف الأحكام القانونية المستجدة، التي كرسها المشرع الجزائري لعقوبة الوضع تحت المراقبة الالكترونية. ولقد تم التوصل الى أن المشرع قد وفق الى حد ما في إرساء منظومة عقابية للوضع تحت المراقبة الالكترونية، لكنها غير متكاملة الأحكام، نظرا لبعض النقائص التي تخللتها. In order to keep pace with scientific developments in the field of modern technology, which have been witnessed by various countries of the world in various fields, the idea of using this technology has emerged in the field of modernizing the penal system of these countries, to avoid the negative effects of short-term custodial penalties on the one hand, and to reduce pressure on penal institutions on the other hand, by searching for other modern punitive methods that are an alternative to these penalties, including placing under electronic surveillance, the latter which was recently introduced by the Algerian legislator as a new trend in the system. Penal law, through Law No. 24-06 of April 28, 2024 amending and supplementing Ordinance No. 66-156 on the Penal Code. On this basis, the aim of this study is to shed light on the various new legal provisions that the Algerian legislator has devoted to the penalty of electronic surveillance. It has been concluded that the legislator has succeeded to some extent in establishing a punitive system for placing under electronic surveillance, but it is not integrated with provisions, due to some shortcomings that permeated it.
