استثمار الوقف في التشريع الجزائري بين الصيغ التقليدية والتوجهات الحديثة

Résumé: يتناول المقال موضوع استثمار الوقف في التشريع الجزائري من خلال تحليل الصيغ التقليدية والحديثة التي تُستخدم لتحقيق التنمية المستدامة. يبدأ المقال بتعريف الوقف من الناحيتين الفقهية والقانونية، مُبرزًا دوره كمؤسسة تنموية ودينية. كما يُسلط الضوء على الإطار القانوني الجزائري الذي ينظم إدارة الأوقاف ويحدد مسؤوليات الهيئات المشرفة عليها. يناقش المقال الصيغ التقليدية مثل الإيجار (الكراء) والبيع والاستبدال، مُوضحًا مزاياها وتحدياتها، وأهمية استمراريتها رغم محدودية تأثيرها في تحقيق التنمية الشاملة. من جهة أخرى، يُبرز أهمية الصيغ الحديثة كصناديق الاستثمار الوقفي والشراكات مع القطاع الخاص، مشيرًا إلى الإمكانيات الكبيرة التي تحملها هذه الصيغ، رغم العقبات التي تواجهها، مثل نقص التمويل والخبرة. يخلص المقال إلى أن الإطار القانوني الجزائري جيد ولكنه يحتاج إلى تحديثات تُواكب التطورات الاقتصادية والاجتماعية. كما يقترح تعزيز الوعي بأهمية الصيغ الحديثة، تطوير التشريعات، وإقامة شراكات مع القطاع الخاص لتحقيق إدارة أكثر كفاءة للأوقاف. Abstract : The article addresses the topic of Waqf investment in Algerian legislation by analyzing both traditional and modern models used to achieve sustainable development. It begins by defining Waqf from both Islamic jurisprudential and legal perspectives, highlighting its role as a developmental and religious institution. Additionally, the article sheds light on the Algerian legal framework that regulates the management of Waqf and outlines the responsibilities of supervisory bodies. The article discusses traditional models such as leasing (Ijara) and substitution (Istibdal), clarifying their advantages, challenges, and the importance of their continuity despite their limited impact on achieving comprehensive development. On the other hand, it emphasizes the significance of modern models, such as Waqf investment funds and partnerships with the private sector, pointing out the substantial potential they hold despite facing obstacles like a lack of funding and expertise. The article concludes that the Algerian legal framework is robust but requires updates to align with economic and social developments. It also suggests raising awareness about the importance of modern models, developing legislation, and establishing partnerships with the private sector to achieve more efficient Waqf management.
