الحماية القانونية لحقوق ذوي الاحتياجات الخاصة: قراءة في دور مجلس أوروبا

Résumé: الملخص: يعتبر مجلس أوروبا منظمة دولية رائدة في مجال حماية حقوق ذوي الاحتياجات الخاصة بالدول السبع والأربعين الأعضاء فيه، بما فيهم دول الإتحاد الأوروبي، نجح على مر السنين في توفير حماية متميزة لهم، امتدت إلى إرساء آليات فعالة، تسهر على ضمان تمتعهم بحقوقهم. ومن هنا تهدف هذه الورقة البحثية إلى تحليل تجربة مجلس أوروبا في هذا الصدد، ودراسة آلياته القانونية والإستراتيجية والمؤسساتية ذات الصلة. ولقد استطاعت هذه الورقة البحثية الوصول إلى نتائج عدة، يذكر من بينها أن مجلس أوروبا أعطى رؤية جديدة، من خلال إستراتيجيته لذوي الاحتياجات الخاصة للفترة الممتدة من2017-2023، معتبرا أن حقوقهم جزءا أصيلا لا يتجزأ من حقوق الإنسان. Abstract: This research paper aims to study the Council of Europe’s role in protecting human rights of persons with disabilities in its forty-seven member states, including all member states of the European Union. In fact, the Council of Europe is considered as a leader organization in establishing effective legal, strategic and institutional mechanisms for persons with disabilities. The study concluded that the new strategies on the Rights of Persons with disabilities 2017-2023 of Council of Europe considers that people with disabilities are citizens like any others and they entitle to have access to and enjoy, the full range of human rights.
