عزل الموظف بسبب اهمال المنصب في التشريع الجزائري Dismiss The Employee For Negligence Of The Post In The Algerian Legislation

Résumé: ملخص : لا يمكن للموظف التغيب عن العمل إلا في إطار العطل والغيابات المبررة قانونا وإلا اعتبر مرتكبا لخطأ مهني يعرّضه للعقوبة التأديبية المناسبة حسب الحالة ، وذلك إما بالجمع بين عقوبتي الخصم من الراتب وإحدى العقوبات التأديبية المنصوص عليها أو بتوقيع عقوبة العزل بسبب إهمال المنصب . إذن يعتبر العزل عقوبة تأديبية يتعرض لها الموظف بسبب ارتكابه لمخالفة إهمال المنصب ، والتي يترتب عنها انتهاء الخدمة وفقدانه لصفة الموظف ، فضلا على حرمانه من التوظيف من جديد في الوظيفة العمومية . ونظرا لخطورة ذلك فقد حرص المشرع الجزائري على وضع ضوابط لتوقيع هذه العقوبة بهدف توفير الحماية للموظف المعني ، ومنع تعسف الإدارة في استعمال سلطتها التأديبية . Abstract: An employee may only be absent from work on legitimate statutory holidays and absences, failing which he is deemed to have committed an occupational error subject to the appropriate disciplinary sanction, either by combining the deduction from the salary and one of the .disciplinary sanctions provided or the penalty of dismissal for professional negligence As a result, the Dismissal is considered a disciplinary sanction against the employee for a negligent shift; resulting in the termination of the service and loss of status, as well as the refusal of re-employment in public service. Given the gravity of the situation, the algerian legislator insisted on putting in place controls to impose this sanction in order to protect the employee concerned; and to prevent the administration from arbitrarily using its disciplinary authority.
