الاستقلالية العضوية لسلطة ضبط البريد والاتصالات الالكترونية: دراسة على ضوء القانون 18-04

Résumé: بهدف ضبط أسواق البريد والاتصالات الالكترونية لحساب الدولة، أنشأ المشرع الجزائري " سلطة ضبط البريد والاتصالات الالكترونية "، بموجب المادة 11 من القانون رقم 18-04 المؤرخ في 10 ماي 2018 المتضمن تحديد القواعد العامة المتعلقة بالبريد والاتصالات الإلكترونية. لضمان فعالية دور هذه السلطة وبلوغ أهدافها، منح المشرع لهذه السلطة الاستقلالية العضوية، التي تظهر لاسيما من خلال تركيبتها والنظام القانوني الذي تخضع له؛ غير أن هذه الاستقلالية تبقى نسبية ومحدودة، بحكم احتفاظ السلطة التنفيذية بعدة صلاحيات تؤثر على الاستقلالية العضوية لسلطة الضبط، وهو ما تسعى إلى توضيحه هذه الدراسة. In order to ensure the regulation of postal markets and electronic communications on behalf of the State, the Algerian legislator created "The Regulatory Authority of the Post and Electronic Communications", in accordance with Article 11 of Law n ° 18-04 of May 10, 2018 laying down the general rules relating to post and electronic communications. To ensure the effectiveness of the role of this authority and the achievement of its objectives, the legislator has granted this authority the organic independence which is manifested by its composition and the legal system. However, this independence remains relative due to the maintenance by the executive of several powers which affect the organic independence of this authority.
