السَّفتجة والتَّظهير التَّوكيلي على ضوء التَّشريع الجزائري

Résumé: للسَّفتجة أهمية ووظيفة بالغة من الناحية العملية، حيث تعمل على ضبط العمليات التجارية، بإعتبارها حلَّت محل النقود في تسوية الديون التجارية، مهما كان النظام الاقتصادي الذي تتبناه الدولة، أما التظهير فيجسد الثقة والسرعة والائتمان، إذ لا یجبر حامل الورقة التجارية على انتظار تاريخ استحقاقها إنما یمكنه تظهيرها للمظهر إليه والحصول على قیمتها، كما یجسد التظهير مبدأ تطهير العيوب التي قد تنشأ عن السفتجة. وبإنشاء السفتجة تفترض وجود ثلاثة أطراف هم: الساحب وهو الآمر بالدفع، المسحوب عليه وهو المأمور بالدفع، المستفيد وهو من صدر الأمر بالوفاء لمصلحته، أي أنه الدائن بقيمتها. Exchange is important and practical in terms of practicality, so as to facilitate the conduct of business operations in the best way, as it replaced the money in the settlement of commercial debt, whatever the economic system adopted by the state, and it emphasizes the pillars of business life are speed and credit , And in the establishment of exchange assume the presence of three persons are: the drawer is the paymaster, the drawee who is ordered to pay, whether the beneficiary who was ordered to fulfill his interest, that is the creditor value of it.
