الخطأ التقصيري الإلكتروني Electronic Delictual Fault

Résumé: ملخص أدت ثورة المعلومات والاتصالات الحديثة وما رافقها من تطور علمي وتكنولوجي إلى ظهور شكل من أشكال الخطأ، نتيجة الاستخدام غير المشروع للحاسوب والإنترنت من خلال استعمال وسائل تقنية مكنت مستخدمو الشبكة ـ أصحاب النوايا السيئة ـ من القيام بأفعال إلكترونية ضارة بالغير تشكل خطأ تقصيريا عبر الانترنت، يختلف من حيث وسيلة ارتكابه والوسائط التي يتم بها عن شكل الخطأ الذي تقوم به المسؤولية التقصيرية التقليدية. نظرا لتعدد صور الأفعال الإلكترونية التي تشكل خطأ تقصيريا يرتكب من خلال شبكة الانترنت يتم تركيز الضوء في هذه المقال على الأخطاء الأكثر شيوعا في البيئة الرقمية والمتمثلة في انتهاك حق المؤلف، وانتهاك الحق في الخصوصية، انتهاك الحق في الصورة، انتهاك الحق في السمعة (التشهير الإلكتروني). Abstarct: The revolution of information and modern communications and the accompanying scientific and technological development has led to the emergence of fault, as a result of the illegal use of computer and Internet through technical means by users with bad intentions performing harmful actions to others that constitute a delictual fault via Internet that differs in its nature form the traditional delictual liability. Due to the multiplicity of kind of electronic acts that constitute a delictual fault via internet, we will focus on the most common mistakes in digital environment like copyright infringement, violation of the right to privacy, violation of the right to image, violation of the right to reputation (electronic defamation).
