ضوابط العمل بالبصمة الوراثية في إثبات النسب أو نفيه على ضوء الفقه الإسلامي والقانون الجزائري.

Résumé: يتفق كل من الفقه الإسلامي والقانون الجزائري على جواز اللجوء إلى الطرق العلمية عموما, والبصمة الوراثية خصوصا, في إثبات النسب, وإنما يختلفان في الاحتجاج بها في النفي, حيث إن الفقه الإسلامي في أغلبه لا يجيز نفي النسب إلا عن طريق اللعان, المنصوص عليه في القرآن. كما يتفقان على جملة الضوابط والشروط في اعتبار البصمة الوراثية طريقا من طرق الإثبات, ومن تلك الضوابط ضرورة الرجوع إلى القضاء, حتى لا يقع التلاعب بأعراض الناس, وتذهب المصلحة المرجوة من هذه الطرق العلمية, في غمرة المفاسد الكبرى, التي منها: التفكك الأسري. ومن الضوابط المتفق عليها كذلك: أن يجرى الفحص الطبي للبصمة الوراثية لدى الجهات الصحية العمومية, سدا لذريعة الجري من وراء الكسب المادي, الذي لا يراعي غالبا الجوانب الأخلاقية. Both Islamic jurisprudence and the Algerian low agree on allowing the use of DNA fingerprinting to prove parentage. However, they disgree upon using this method to prove the opposite. I.e proving that one child doesn't blong to aalledged father. Through the Islamic fikh made possible to ressort to what is called (curse),a sort of oath or cursing. However, the Islamic fikh impose some restrictions when resorting to geniting fingerprinting DNA .On other words, it is allowable withim strict limits and conditions, for example it must apply to the legal procedures so as to prevent all sorts of manipullqtions. Thus, we make sure that the expected aims are achived perhaps, the chief target is to prevent family disintegrqtion. Also, parentage tests are not valid unless they are carried out by specialised health bodies. So qs to ovoid any unethical and dishonest practices.
