Résumé: ملخص: إن لمبدأ المساواة بين المساهمين في شركة المساهمة دور ذو أهمية بمكان في الحفاظ على حقوق المساهمين فيها، حيث كفل المشرع الجزائري الحماية للمساهمين فيها بالنص على المساواة بينهم في الحقوق والالتزامات رغم ما قد يرد عليه من استثناءات وهذا ضمانا لبقاء الشركة ، كما حرص على حماية هذا المبدأ من الاختلال الذي قد يطاله من طرف هيئات الشركة، من خلال وضع آلية رقابية متخصصة تتمتع بالاستقلالية عن الشركة كلفها بمهمة حماية مبدأ المساواة بين المساهمين ومنحها ضمانات لذلك تتمثل هذه الهيئة في محافظ الحسابات. الكلمات المفتاحية: Abstract: The principle of equality between the shareholders of a joint-stock company plays an important role in the preservation of the rights of its shareholders. In order to ensure the survival of the company, the Algerian legislator ensured the protection of its shareholders by stipulating equality between them in rights and obligations despite the derogations that may be received. It also wanted to protect this principle from the imbalance that could be affected by the organs of society, by the establishment by the legislator of a specialized control mechanism independent of society, entrusting it with the mission of protecting the principle of equality between the shareholders and to give it guarantees, this authority is therefore represented in the statutory auditors.
