أثر منع الاستكشاف المباشر على خصوصية المستهلك الالكتروني

Résumé: أدت تكنولوجيا الاعلام والاتصال إلى المساس الفاضح بخصوصيات الأشخاص، تبعا لذلك، أصدر المشرع الجزائري القانون رقم: 07/18 المتعلق بحماية الاشخاص الطبيعيين في مجال المعالجة الآلية، خاصة المادة 37 منه، المنصبة على حماية المستهلك، في إطار الترويج للبضائع والسلع عبر الوسائل الالكترونية، وعدم اقتحام خصوصيته عن طريق استكشاف معطياته، وهو ما يطلق عليه تسمية: " منع الاستكشاف المباشر" . تهدف هذه الدراسة إلى تبيان الآليات القانونية والضمانات التي وضعها المشرع الجزائري لحماية خصوصية المستهلك الالكتروني عبر الوسائط الالكترونية، ومن بين أهم هذه الآليات هو استحداث السلطة المستقلة لحماية المعطيات ذات الطابع الشخصي، ونظرا لحداثة المصطلح في المنظومة القانونية الجزائرية، فقد تناولنا أساس هذه التسمية وارتباطها بالاستبيان المباشر المنصوص عليه في قانون التجارة الالكترونية. Among the features of technology was the flagrant violation of the privacy of persons, and inparallel with this, the law N° 07/18 on the Protection of Natural Persons in the Field of Mechanical Processing, among others, in its articles : 37, which addressed the Algerian legislature's position on consumer protection and wanted to protect it in the promotion of goods and goods through electronic means. Not to break into his privacy by exploring his features, which is called "preventing of the direct exploration". The objective of this topic is to identify the legal mechanisms and safeguards developed by the legislature to protect electronic consumer privacy through electronic media, among the most important of which is to develop the independant authority to protect personal data. As the new term in the Algerian legal system, we have addressed the basis of this designation and its connection with the direct questionnaire provided for in the Electronic Commerce Act.
