نحو تنظيم قانوني للذكاء الاصطناعي في حياتنا: إشكالية العلاقة بين البشر والآلة

Résumé: إن استخدام الروبوتات و برامج الذكاء الإصطناعي في مختلف القطاعات يثير العديد من الصعوبات لا سيما فيما يتعلق بالمسؤولية عن أعمال هذه البرامج و مدى ملائمة التشريعات الحالية و قدرتها على استيعاب الخصائص الفريدة لهذه التقنية. و بناء عليه، فإن هذه الدراسة تسعى إلى مناقشة بعض التحديات الحالية للذكاء الاصطناعي أو تلك التي يمكن أن تثور في المستقبل و بخاصة إذا تطورت تقنية الذكاء الإصطناعي و استخدمت على نطاق واسع. بالإضافة إلى ذلك، فإن الدرسة تسلط الضوء على ملامح الإطار القانوني الوطني و الدولي الناظم لتقنية الذكاء الاصطناعي، و ذلك بهدف تحديد ما الذي ينبغي أن يكون عليه القانون لاستيعاب التحديات الأخلاقية المرتبطة باعتماد و استخدام تقنية الذكاء الاصطناعي في حياتنا. الكلمات المفتاحية: الروبوت، المسؤولية، الشخصية القانونية، الذكاء الإصطناعي، الرعاية الصحية Using Robots and Artificial Intelligence programs in different sectors generates considerable difficulties especially with regard to the attribution of liability for the actions of such programs, and whether or not the current law adequately accommodates the unique aspects of Artificial intelligence technology. This study thus explores the most recent challenges raised by artificial intelligence technology, or those which might arise if such technology evolves, or is commonly used on a larger scale. Furthermore, it examines the national and international legal framework regulating artificial intelligence and address the issue of what the law ought to be in order to adequately accommodate the ethical challenges associated with the adoption and use of artificial intelligence technologies in our normal lives.
