Résumé: الملخص يعد الاستحسان من المصادر التي تضفي على الشريعة الإسلامية مرونة وتجددا في التعامل مع الحوادث والوقائع، ومع ذلك فقد اختلف فيه العلماء من مختلف المذاهب سواء من حيث المفهوم أو الحجية، خاصة في المذهب المالكي، وعليه فإن هذا البحث يتناول دراسة أصل الاستحسان في المذهب المالكي، ومدى احتجاج الإمام عبد الرحمان بن القاسم به، وذلك من خلال البحث في أقواله وإبراز تطبيقات الاستحسان الفقهية في أهم مدون فقهي عند المالكية وهو المدونة الكبرى، وليتأتى ذلك تناولت في هذه الدراسة مصطلح الاستحسان بالبحث وحددت مفهومه عند علماء المذهب وأنواعه المعتمدة عندهم، مع بيان مدى حجية العمل به وموقف الإمام مالك منه، وضوابط العمل به، وقد جمع ذلك كله في مبحث عنوانه التأصيل الشرعي لأصل الاستحسان في المذهب المالكي، ثم أردف بمبحث ثان تضمن نماذج وتطبيقات الاستحسان عند الإمام عبد الرحمان بن القاسم من خلال المدونة الكبرى وقد تم تصنيفها حسب الأنواع المذكورة في المبحث الأول قدر المستطاع، ليتوصل في الأخير إلى مجموعة من النتائج أبرزها أن الاستحسان حجة عند الإمام مالك وصاحبه عبد الرحمان بن القاسم وله أنواع عديدة تبعا للدليل المستند إليه. Abstract Summary Istihsan is one of the sources that give Islamic Shria flexibility and renewal in dealing with events and facts. However, scholars from various schools of thought differed in it, whether in terms of concept or authenticity especially Maliki school. Accordingly, this research deals with the study of the principle approbation in the maliki school, and the extent of wich the protest of Imam Abd El Rahman Ibn El Qassim about, and this trough making a research on his speechs and highliting the applications of jurisprudential approbation in the most important jurisprudential blogger of the malikis, which is the great blog, in order to achieve this; i dealt with in this study the term approbation by research and determined its concept according to the scholars of the sect and it is approved types, with an indication of the extent of its validity, Imam Malik’s position on it, and the rules for working with it i collected all of this in a study entitled the legal rooting of the principle of approbation in the maliki school of though, then i added it to a second topic , which included models and applications of approbation of Imam Abd El Rahman Ibn El Qassim through the great blog, i classified them according to the types mentioned in the first topic as much as possible to end with a set of results, the most prominent of wich is that approbation is an argument for Imam Malik and his companion Abd El Rahman Ibn El Qassim, and has many types according to the evidence based on it.
