تطبيقات الذكاء الاصطناعي كسبب أجنبيً مستجد لقطع العلاقة السببية في المسؤولية الطبية Artificial Intelligence Applications As A New Foreign Reason For Severing The Causal Relationship In Medical Liability

Résumé: تتناول هذه الدراسة إمكانية إعتبار تطبيقات الذكاء الاصطناعي سببآ أجنبيآ في قضايا المسؤولية الطبية، وتهدف إلى تحليل المبادئ القانونية المتعلقة بالسبب الأجنبي وقطع العلاقة السببية، ومناقشة هاته إلإمكانية، مع تقديم مقترحات لتطوير إطار قانوني ينظم استخدام الذكاء الاصطناعي في المجال الصحي. تبرز أهمية الموضوع في ظل تزايد الاعتماد على تطبيقات الذكاء الاصطناعي في المجال الطبي وما يترتب عليه من مخاطر محتملة وصعوبة تحديد المسؤولية. وبالرغم من كل هذه المزايا التي توفرها تطبيقات الذكاء الاصطناعي، إلا أنها تطرح عدة تحديات أخلاقية وإشكالات قانونية، وهنا تثور الاشكالية التي مفادها: ما مدى إمكانية إعتبار تطبيقات الذكاء الاصطناعي سببًا أجنبيًا مستجدآ لقطع العلاقة السببية بين أفعال مقدمي الرعاية الصحية والأضرار التي تلحق بالمرضى؟ تعتمد الدراسة على المنهج التحليلي والمقارن، حيث تم تحليل القوانين والأحكام القضائية المتعلقة بالمسؤولية الطبية والسبب الأجنبي في الجزائر ومقارنتها ببعض الدول الأخرى. خلصت الدراسة إلى أن تطبيقات الذكاء الاصطناعي تثير تحديات قانونية معقدة تتطلب تطوير تشريعات جديدة لضمان الاستخدام الآمن والأخلاقي لمثل هاته التطبيقات في المجال الطبي، مع حماية حقوق المرضى. الكلمات المفتاحية: المسؤولية الطبية، العلاقة السببية، السبب الأجنبي، تطبيقات الذكاء الاصطناعي كسبب أجنبي مستجد. Abstract: This study addresses the possibility of considering artificial intelligence applications as a foreign cause in medical liability cases, and aims to analyze the legal principles related to the foreign cause and severing the causal relationship, and discuss this possibility, with proposals to develop a legal framework regulating the use of artificial intelligence in the health field. The importance of the topic is highlighted in light of the increasing reliance on artificial intelligence applications in the medical field and the resulting potential risks and difficulty in determining liability. Despite all these advantages provided by artificial intelligence applications, they pose several ethical challenges and legal problems, and here the problem arises: To what extent can artificial intelligence applications be considered a new foreign cause to sever the causal relationship between the actions of health care providers and the harm caused to patients? The study is based on the analytical and comparative approach, as the laws and judicial rulings related to medical liability and the foreign cause in Algeria were analyzed and compared with some other countries. The study concluded that artificial intelligence applications raise complex legal challenges that require the development of new legislation to ensure the safe and ethical use of such applications in the medical field, while protecting the rights of patients
