التكييف القانوني للجرائم المرتكبة من قبل كيانات الذكاء الاصطناعي Legal Adaptation Of Crimes Committed By Artificial Intelligence Entities

Résumé: عالجت هذه الدراسة أحد أهم الإشكالات القانونية التي نجمت عن تطبيقات تقنيات الذكاء الاصطناعي، والمتعلقة بالمسؤولية الجزائية لكيانات الذكاء الاصطناعي وذلك عند ارتكابها للجرائم ضد الأشخاص, فلقد وقفت هذه الدراسة على تحديد الطبيعة القانونية لكيانات الذكاء الاصطناعي وذلك من خلال الوقوف على مدى الاعتراف بالشخصية القانونية لها وكذا تحديد المسؤولية الجزائية الناجمة عن جرائم هذه الكيانات، محاولين عرض وتحليل النصوص القانونية التي تحكم الجرائم المرتكبة من قبل كيانات الذكاء الاصطناعي والعقوبات التي يمكن تسليطها على هذه الكيانات الذكية. This study addressed one of the most important legal problems resulting from the applications of artificial intelligence technologies, related to the criminal liability of artificial intelligence entities when they commit crimes against people. This study focused on determining the legal nature of artificial intelligence entities by determining the extent of recognition of their legal personality, as well as determining the criminal liability resulting from the crimes of these entities, trying to present and analyze the legal texts that govern crimes committed by artificial intelligence entities and the penalties that can be imposed on them. These are intelligent entities.
