حق عدول السائح عن التعاقد في عقد السياحة

Résumé: الملخص تحتل وكالة السّياحة المركز المهني المحترف مقارنة مع السّائح الذي يظهر كطرف ضعيف، والذي يمتاز بجهله للمعلومات حول الخدمة التي بتعاقد عليها، ونجد المهني دائمًا يسعى إلى جذب عدد كبير من المستهلكين باستعمال وسائل الإشهار التي توثر على نفسية المستهلك (السائح)، لذلك ومن أجل حمايته، عملت العديد من التشريعات القانونية إلى النّص على منحه الحق في العدول عن العقد بعد إبرامه، والذي اعتُبِر إنتهاكًا لمبدأ القوّة الملزمة للعقد، مفاده أنّ العقد شريعة المتعاقدين فلا يجوز نقضه ولا تعديله دون اتفاق إلاّ ما سمح به القانون، في حين أنّ حق العدول هو إمكانية إنهاء العقد، فهو آلية تسمح للمستهلك بأن يعدل العقد بإرادته المنفردة، خلال مدة زمنية محدّدة إمّا قانونًا أو اتفاقًا. الكلمات المفتاحية: وكالة السّياحة، السّائح، القوة الملزمة للعقد، الحق في العدول. Abstract The tourism agency occupies the professional, professional position compared to the tourist, who appears as a weak party, and who is characterized by his ignorance of information about the service that he contracts with. To protect him, many legal legislations worked to provide for him the right to rescind the contract after its conclusion, which was considered a violation of the principle of binding force of the contract, according to which the contract is the law of the contracting parties and it is not permissible to revoke or amend it without an agreement except what is permitted by law, while the right to rescind is The possibility of terminating the contract, as it is a mechanism that allows the consumer to modify the contract unilaterally, within a specified period of time, either by law or by agreement.
