سلطات الضبط في مجال النشاطات المالية والطاقوية والشبكاتية ودورها في الترخيـص بالاستـثمار

Résumé: تعد سلطات الضبط في المجالين الاقتصادي والمالي فئات قانونية جديدة ضمن المنظومة القانونية الجزائرية، حيث استلهم المشرع الجزائري نموذجها من تشريعات دول أخرى وأوكلت لها اختصاصات ذات طبيعة متنوعة ومنسجمة مع مفهوم الضبط الاقتصادي؛ فإلى جانب الرقابة التي تمارسها على السوق فقد منح المشرع للبعض منها ممارسة رقابة قبلية تتمثل في منح الترخيص للمستثمر كشرط للقيام بمشروعه الاستثماري، و هذا في إطار ما يعرف بالأنشطة المقننة، وتمارس سلطات الضبط هذه الرقابة من خلال إصدار قرارات فردية ذات تأثير في سوق النشاط المعني من حيث عدد ونوعية المستثمرين، لكن ورغم أن هذه الهيئات تعتبر بديلا عن الإدارة التقليدية، فإن المشرع قد قيد هذه الرقابة بتدخل السلطة التنفيذية، وهو ما يعد تهديدا لوجود هذه الهيئات وللدور الذي تقوم به في هذا الإطار. The Algerian legal system has set new regulatory authorities in the economic and financial fields. The models applied in different countries have inspired the legislator to initiate a model with a number of different jurisdictions which are consistent with the concept of economic regulation. Besides its control over the market, some authorities exert pre control in granting the license for the investor before undertaking the investment project. The control authorities exert this control by issuing decisions that have an impact on the market in terms of the number and quality of investors. . Although these bodies are a substitute for traditional administration, the legislator has restricted this control by allowing the interference of the executive branch, which is a threat to the existence of such bodies and the role they play in this regard.
