دور النزاعات الحديثة في تطوير أساليب تنفيذ قواعد القانون الدولي الانساني (the Role Of Modern Conflicts In Developing Methods For Implementing The Rules Of International Humanitarian Law

Résumé: إن الآليات الواردة ضمن قواعد القانون الدولي الانساني تعتمد في أغلبها على مبادرة أطراف النزاع بالإضافة الى أن الحلول المقدمة في هذا الشأن تقوم على مبدأ تقليل معاناة الضحايا و الخسائر أكثر من حمل أطراف النزاع على احترام القواعد الانسانية . و أما بخصوص الآليات المستحدثة فعلى الرغم من قيام مجلس الأمن بما له من اختصاصات و صلاحيات بتكييف خروقات القانون الدولي الانساني ضمن واجباته في حفظ الأمن و السلم تحت الدواعي الانسانية و القانونية إلا أن الأثر البالغ للسياسة الدولية قد أدى الى الانحراف بهذا العمل عن الأهداف الانسانية مما يثبت عجز هذه الأساليبو الآليات في تنفيذ قواعد القانون الدولي الانساني و هو ما يتطلب تغيير أو على الأقل مراجعة استراتيجية مجلس الأمن في عمليات التنفيذ. The mechanisms contained within the rules of international humanitarian law depend mostly on the initiative of the parties to the conflict. In addition, the solutions provided in this regard are based on the principle of reducing the suffering of victims and losses rather than forcing the parties to the conflict to respect humanitarian rules. As for the new mechanisms, although the Security Council, with its powers and powers, has implemented violations of international humanitarian law within its duties to maintain peace and security under humanitarian and legal reasons, the severe impact of international policy has led to this work deviating from humanitarian goals, which It proves the inability of these methods and mechanisms to implement the rules of international humanitarian law, which requires changing or at least reviewing the Security Council’s strategy in implementation operations.
