المنظومة القانونية لحق التمثيل السياسي للمرأة في الجزائر – دراسة بين النص والواقع-.

Résumé: سعت الجزائر من خلال دساتيرها المتوالية لتكريس حقوق المرأة السياسية، وخاصة منها مشاركتها في التمثيل السياسي في المجالس المنتخبة سواء على المستوى الوطني أو على مستوى المجالس المنتخبة المحلية، وكان ذلك بداية من دستور 1989 الذي كرس مبدأ التعددية الحزبية وألزم الأحزاب السياسية ضرورة مشاركتهم المرأة في ذلك. غير أن الظروف التي مرت بها الجزائر عرفت نوعا من الركود في دور المرأة في ممارسة حقوقها السياسية وتمثيلها في المجالس المنتخبة على المستويين الوطني والمحلي، هذا ما دفع بالمشرع الجزائري لتعديل قانونه الانتخابي وقانون الأحزاب السياسية الذي ألزم من خلاله الأحزاب بضرورة تمثيل المرأة وذلك من خلال نظام الكوطة حتى يتسنى للمرأة ممارسة حقوقها في إيصال صوتها ومشاركة الرجل في صنع القرار السياسي. Abstract: Through its successive constitutions, Algeria has endeavoured to enshrine women's political rights, especially their participation in political representation on elected councils, both at the national level and at the level of local elected councils, beginning with the 1989 Constitution, which enshrined the principle of multiparty politics and obliged the parties The need for women to participate in that. However, Algeria's circumstances have defined a stagnation in the role of women in the exercise of their political rights and their representation in elected councils at the national and local levels, which prompted the Algerian legislature to amend its electoral law and the Political Parties Act, through which the parties were obliged to Women's representation through the Kuita system so that women can exercise their rights to communicate their voice and men's participation in political decision-making.
