Résumé: الملخص: تناولنا في هذا البحث أحد أهم الموضوعات و القضايا المستجدة التي أفرزتها التطورات الاجتماعية و الاقتصادية، و هو موضوع أثر عمل المرأة عي النفقة الزوجية، حيث كانت دراستنا لهذا الموضوع من عدة نواحي، أولهم ناحية الفقه الإسلامي، حيث تم تبيان الاختلاف الفقهي في هذه المسألة بين من جعل عمل الزوجة مسقطا لحقها في النفقة، و بين من قال بعدم سقوطها. و أيضا بينا في هذا البحث موقف الاتفاقيات الدولية التي ترى كأصل عام أو واجب الإنفاق على عاتق الزوجين معا، تحقيقا لمبدأ المساواة بين الجنسين. ثم تطرقنا إلى موقف كل من قانون الأسرة الجزائري و مدونة الأسرة المغربية اللذان كانت مرجعيتهما في هذه المسألة الشريعة الإسلامية، و لم يكن للاتفاقيات الدولية أي أثر في مسألة نفقة الزوجة العاملة عليهما، على عكس مجلة الأحوال الشخصية التونسية و التي تبين من تحليل أحكامها أنها تأثرت في تعديلها الأخير بالاتفاقيات الدولية، و حاولت تكريس مبدأ المساواة بين الجنسين في مسألة النفقة الزوجية Abstract : We dealt with this research One of the most important topics and contemporary issues،produced by social and judicial developments،It is the subject of the impact of women's work on marital alimony،Where we studied this topic from several aspects،The first in terms of Islamic jurisprudence، Where the jurisprudential difference in this issue has been clarified An opinion that made a woman’s work forfeit her right to alimony،And some of themsaidthather right does not fall. Thenwediscussed the position of each of the Algerian familylaw and Moroccanfamily blog whosereference in thismatterwas the Islamic Sharia،The international conventions had no effect on the issue of alimony for the workingwife،Unlike the TunisianPersonalStatus Code Whichisevidentfrom the analysis of its provisions Which, in itslatestamendment, wasaffected by international conventions،And I tried to perpetuate the principle of genderequality in the matter of marital alimony.
