الحماية الجنائية للممتلكات الثقافية

Résumé: تعالجُ هذه الدراسة مسألة مدى كفاية الحماية الجزائية للممتلك الثقافي بمختلف صوره: العقاري، المنقول و غير المادي؛ و هي تهدفُ بداية إلى محاولة ضبط المعنى التشريعي الدقيق لمحلّ تلك الحماية، و ذلك على ضوء أحكام القانون رقم 98-04 المُؤرّخ في 15 يوليو 1998 المُتعلّق بحماية التراث الثقافي والنصوص التنظيمية المُرتبطة به. كما تهدف الدراسة إلى محاولة حصر نصوص التجريم ذات الصّلة بالممتلكات الثقافية، وهي النصوص التي تتميّزُ بتعدّدها (تبعًا لصور الحماية) وتفرّقها في عدّة قوانين. Abstract This study addresses the issue of the adequacy of criminal protection for cultural property in its various forms: real estate, movable, and intangible. It aims, initially, to attempt to define the precise legislative meaning of the subject of that protection, in light of the provisions of Law No. 98-04 dated July 15, 1998, concerning the protection of cultural heritage and the related regulatory texts. The study also aims to identify criminalization texts related to cultural property, which are characterized by their multiplicity (according to the forms of protection) and their dispersion across several laws.
